2.3 Audio-First Experience

Backseat Geologist is primarily an audio-based experience designed for passive listening while traveling, similar to podcasts, audiobooks, or music. While the app includes maps and readable descriptions, the core experience:

• Operates in the background without requiring screen interaction
• Automatically plays geological narration based on your location
• Is designed for hands-free listening during travel
• Does not require driver attention or interaction while in use

3. Subscription Service

3.1 Subscription Tiers

• Free: Basic features with usage limits
• Premium: Enhanced features and higher usage limits
• Max: Enhanced features with maximum usage limits

3.2 Billing and Payments

• All payments processed through Apple App Store or Google Play Store
• Subscriptions auto-renew unless cancelled
• Cancellation must be done through iOS Settings > Subscriptions or Google Play Store
• Refunds handled according to Apple's refund policy or Google Play Store's refund policy

3.3 Usage Limits

• Different tiers have different monthly usage limits
• Limits reset monthly on subscription anniversary
• Exceeding limits may restrict certain features

4. User Responsibilities

• Descriptions simplified for accessibility to general audiences
• Scientific terminology may be adapted for clarity

6. Location and Navigation Disclaimers

6.1 Location Accuracy

• GPS accuracy varies based on device, weather, and terrain
• Location services may be degraded in remote areas

• App may cache and process your routes locally for functionality
• No user content is uploaded to our servers without explicit action

8. Service Availability

8.1 Network Dependencies

• Some features require internet connectivity
• Voice generation requires connection to TTS services
• Geological data queries and descriptions require internet access
• Downloaded content available offline

8.2 Service Interruptions

• Services may be temporarily unavailable
• Third-party dependencies may affect functionality
• We strive to minimize service disruptions

9. Limitation of Liability

9.4 Assumption of Risk

11. Termination

• Uninstall the app to terminate use
• Cancel subscriptions through iOS Settings
• Local data remains on device until app is deleted

11.2 By Us

• App is used for dangerous or illegal activities
• Technical abuse or excessive server usage occurs

These terms are governed by Georgia state law. Any disputes will be resolved in Georgia.

14. Indemnification

You agree to indemnify and hold harmless Blake Morgan, Backseat Geologist, and any affiliated parties from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the app
• Your violation of these Terms
• Your violation of any third-party rights
• Any accident or injury occurring while using the app or visiting locations mentioned in the app

15. Dispute Resolution

Any disputes arising from these Terms or your use of Backseat Geologist shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Georgia. You waive any right to participate in class action lawsuits against Backseat Geologist.
